Reckless Driving

What is Reckless Driving Law?

Reckless driving, or "careless driving," is a serious traffic violation in which the driver operates a vehicle in a reckless manner, with disregard for the safety of others. Reckless driving is highly dangerous, as it can lead to serious accidents with other drivers, pedestrians or personal property that may result in severe injuries, property damage, and death to the driver or others. Actions that qualify as reckless driving include:

  • Driving 25 miles per hour or more over the speed limit
  • Evading or fleeing from law enforcement
  • Racing with another vehicle
  • Passing another vehicle in a no-passing zone or where there is limited or no visibility of oncoming traffic

A reckless driving offense is considered a class 2 misdemeanor in most states. If charged with reckless driving, a person can be punished with:

  • Jail time for periods of up to 4 months
  • 2 or more years of probation
  • Fines of up to $750
  • License suspension

If a person already has a previous reckless driving charge, the conviction would be raised to a class 1 misdemeanor and the penalties will be increased with longer jail time, higher fines, and the driver's driving license being revoked.

Reckless Driving Lawyers

Reckless driving convictions can lead to extreme consequences, thus it is important to consult with a traffic law attorney if you are charged with such a crime. Traffic law lawyers have experience in handing reckless driving cases. An attorney may be able to help you avoid unnecessary punishments and may be able to get your charge reduced.
