When filing a civil appeal, a panel of appellate justices will decide if the appeal is approved or denied. In order to win an appeal, there must have been an error or mistake made in the initial court's decision. No new evidence can be submitted; therefore without plausible grounds for the appeal, the case may be lost or denied. However, if one should lose the appeal, there are other options. These lost civil case options may include:

  • Letting the decision stand as is and taking no further action
  • File a petition for rehearing if the appellate court has made an important error
  • Request that the case be transferred to the Court of Appeal if it was previously in an appellate division of the superior court and if there is reason for the Court of Appeal to ensure the court decisions are uniform and/or to settle a question of law
  • Request that the case be transferred to the Supreme Court if it was previously in the Court of Appeal and if there is reason for the Supreme Court to ensure the court decisions are uniform and/or to settle a question of law

Lost Civil Case Legal Options:

While there are lost civil case options for those that lose a civil appeal, they may not be viable options for everyone and they may be difficult to navigate on one's own. For example, there must be a clear mistake or error made by the appellate court if one wishes to file a petition for a rehearing. Similarly, there must be plausible grounds for believing that two courts have interpreted the law differently or that an important question of law is involved in order for one to request that the case be transferred to the Court of Appeal from a division of the superior court. If one wishes to exercise the last lost civil case option of filing a petition for a "writ of certiorari" (a transfer to the Supreme Court), then the case must also involve an unusually important question of law or difference of interpretation, and the odds of getting the transfer approved are generally slim.
