Fireworks Accident Injury Law

Fireworks Accident Injury Law:

During both public and private fireworks displays, accidents, injuries and even fatalities unfortunately can occur. This may be caused by a fireworks device malfunctioning or by improperly trained technicians setting up the displays. Fireworks accidents are also likely to occur when civilians attempt to light their own fireworks, such as sparklers, bottle rockets and firecrackers. Explosions can occur, debris can be fired into crowds, and fires can ignite due to the slightest defect or mistake.

The US Consumer Product Safety Commission (CPSC) is responsible for regulating the manufacturing and performance requirements of fireworks and some states have strict bans on consumer fireworks. However, fireworks accidents still can occur. Many of these are fatal accidents.

In 2012, the CPSC reported approximately 8,700 injuries due to fireworks, including a combination of spectator-related injuries and civilians attempting to use firecrackers and sparklers. Injuries range from burns to dismemberment to wrongful death. Many people do not remember that fireworks are explosives and thus carry certain dangers if mishandled.

Fireworks Accident Legal Issues:

Lawsuits are not uncommon against companies that manufacture fireworks, promoters/sponsors that display public fireworks, pyrotechnic professionals and consumers that host their own fireworks at home. Aside from malfunctions in the fireworks devices, claims of negligence and premises liability are common as well. California defines negligence as a "lack of ordinary care" that results in injury and/or damage, with a higher standard of caution applied to those partaking in "dangerous activities."

Negligence claims, however, can be complex due to personal injury attorneys being unfamiliar with fireworks accidents, complicated local and federal fireworks laws, and the fact that many fireworks manufacturers are overseas. Investigations can also become problematic in determining who is actually liable for the fireworks accident.

Unfortunately then, many victims do not receive proper compensation for their injuries, losses, and suffering in relation to fireworks accidents.
